Council amends deannexation ordinance to keep Lot 6 and pursue deannexation of Lot 51

The City Council voted on second reading to amend ordinance number 19, keeping Lot 6 inside the city and pursuing deannexation of Lot 51 after a presentation from a property representative.
Scott Lewis, of Grama Engineering and Surveying, told the council he was presenting at the request of the property owner, who was out of town. "He is proposing and hopefully the County the City Council will accept," Lewis said, and described Lot 6 as having existing improvements — curb and gutter, fencing, asphalt and a building — while Lot 51 had no structures.
Council members and staff asked how the change would affect jurisdiction for Market Road and easements. A staff member said Department of Regional Comments (DRC) notes indicated Market Road would transfer to the county if deannexed, but Lewis noted an easement of record dedicated the road on the subdivision plat and "I don't think any of that would change." Staff also said county paperwork had been reviewed and they did not see a legal obstacle to proceeding.
One council member recalled a previous negotiation on this property two years earlier and said the earlier deal had not been completed, asking whether the council could provide any guarantee. Another council member suggested a contingent amendment could be used; the council ultimately moved, seconded and approved the ordinance "as amended" to retain Lot 6 and deannex Lot 51 on second reading.
The council expressed appreciation for Lewis's work on the plat and the amendment. After the ordinance vote, the council moved into executive session under the statute cited during the meeting.
What the ordinance changes: the amendment leaves existing improvements on Lot 6 in place and removes Lot 51 (previously referenced as Lot 5 in earlier documents) from the deannexation that had been proposed; the council discussed that any transfer of road jurisdiction to the county would follow normal county review and the recorded easement would remain in the public record.
Next steps: The council implemented the amendment on second reading and entered executive session; staff and county review may be required for any formal deannexation steps.
