The Pottawattamie County Board of Supervisors unanimously approved Resolution No. 22-2026 on March 31 to authorize electronic bidding procedures and the distribution of a preliminary official statement in connection with the sale of notes to pay for acquisition, construction and installation of peace officer equipment and emergency services communications equipment, including new towers, microwave links and consoles.
The resolution notes the county has followed Sections 331.402 and 331.443 of the Code of Iowa and that the county's municipal advisor, Speer Financial, Inc., prepared a Preliminary Official Statement. The document was approved as to form and deemed final for purposes of SEC Rule 15c2-12, subject to revisions by the chair and the county auditor upon advice of bond counsel and disclosure counsel. The resolution also found that receipt of electronic bids via facsimile and the SPEERAUCTION competitive bidding system provides reasonable security and preserves the integrity of the competitive process.
"The preliminary Official Statement in the form presented to this meeting be and the same hereby is approved as to form and deemed final for purposes of Rule 15c2-12 of the Securities and Exchange Commission," the resolution states, while authorizing the county chair and auditor to make any ministerial changes before distribution.
Board members voted by roll call; the clerk recorded AYES from Chairman Brian Shea and Supervisors Tim Wichman, Susan Miller, Jeff Jorgensen and Keith Jones. The resolution passed as presented (Resolution No. 22-2026).
Next steps identified in the resolution include distribution of the preliminary official statement to potential bidders and acceptance of bids through the approved electronic and sealed bidding procedures. The resolution does not set a sale date in the meeting record; timing and final terms will follow the municipal advisor's and bond counsel's coordination.
