The chair, introducing the amendment, said it "requires any contractor on a public works project to sign a notarized affidavit attesting to the fact that it employs only legal workers and that it will, upon request, produce an E‑Verify number for any and every employee on the public works project." The chair said the provision is intended to ensure Hoosier tax dollars are spent on legal workers and to help projects be completed "on time, on budget."
Senator Daskin questioned how the "upon request" language would be applied over a multi‑phase project, asking whether verification could be presented later during a job. The chair responded that documentation must be produced "within three days" of a request. Senator Pohl raised concern that current law already requires submission of E‑Verify numbers to the agency and asked whether the amendment could unintentionally weaken that duty; the chair said the amendment adds a notarized affidavit and is intended to expand and strengthen compliance, and she expressed willingness to consider clarifying language on second reading.
Committee members took the amendment by consent, moved to pass SB 87 as amended, and the clerk announced the bill passed 10‑0.
The measure will proceed as amended; committee members indicated they may refine technical language on later readings to address access and timing questions raised in committee.
