Staff told the Wetlands Board that the marina proposal — presented by watershed planner Emily Grojean — would remove some older in-water structures and construct three 5-by-150-foot floating piers with finger piers providing a total of 36 wet slips, along with shoreline stabilization including a 65-foot stone sill with 2,500 square feet of sand nourishment and riprap revetments. Grojean said staff had reviewed the application against the February 1, 2025 wetlands mitigation policy and found no vegetated-wetland impacts, so no mitigation was required; staff recommended approval with the condition that the applicant obtain all federal, state and local permits and comply with James City County flood-plain regulations.
The project's agent, Joseph Scott of Solterra Solutions LLC, said the site is an "old site that is being revived by the folks that own it to turn it back into a marina," and described removing broken concrete rubble, installing filter cloth and placing stone revetment where needed. Scott said the U.S. Army Corps of Engineers' permit was in hand and the applicant still required VMRC and other permits before beginning construction, which the applicant hopes to start as soon as the remaining approvals are secured.
After board members said they had not heard from adjacent property owners and described the on-site structures as failing, the Wetlands Board adopted the resolution granting permit WJPA-26-0001 for 4125 South Riverside Drive by a 5–0 vote.
At the Chesapeake Bay Board meeting that followed, Grojean presented three residential matters. For CBPA-26-0019 (168 The Main), staff reported 656 square feet of impacts to the 100-foot landward RPA buffer, 290 square feet to the 50-foot seaward buffer and 942 square feet of overall impervious impacts; required mitigation equaled 2.5 planting units and the applicants' plan exceeded that by 1.5 units. Staff recommended approval conditioned on required permits, a $3,000 surety submitted to the county attorney's office to guarantee the mitigation plan and an expiration date for starting construction of April 8, 2027. Applicant Dan Walls said the proposal was straightforward; the board approved the exception 5–0.
For CBPA-26-0001 (5505 South Mallard Run), staff said the after-the-fact deck, patio and fire pit resulted in 612 square feet of RPA impacts and, because the work is after the fact, mitigation requirements were doubled to three planting units. Applicant Michael Roselli apologized for relying on contractor advice that permits were not required and said he had planted 18 Arborvitae to reduce runoff; the board found no visible sedimentation issues in the site photos and approved the exception 5–0 with the staff-recommended conditions and surety.
The board then heard a major-impact exception for CBPA-26-0021 (139 Kings Pointe Drive), where staff reported 3,927 square feet of impervious RPA impacts and mitigation requirements of nine planting units. Crossroad Custom Builders' Sean Lemon said grading and drainage adjustments would be needed for the proposed 1,700-square-foot house and 560-square-foot deck and offered to bring a revised stormwater plan if the board deferred. Neighbor Mark Meadows told the board the lot is a narrow spit of hardwood forest with significant slope, wildlife habitat and concerns about future subdivision pressure.
"I think at this point it would be wise for us to request a deferral to the June meeting," Lemon said, adding the team would propose piping gutters underground to a small stilling/infiltration basin. The board accepted the deferral and left the public hearing open for CBPA-26-0021 so the applicant can return with additional engineering and mitigation details.
Board business concluded with an announcement that neither board will meet in May; both bodies adjourned by unanimous vote.
