The Village of Maywood Board considered a contested application to erect a billboard on Harrison Street between 10th and 13th Avenue on March 17, 2020. Director of Community Development David Myers told the Board the applicant is protesting the Zoning Ordinance requirement to notify surrounding property owners by mail within 350 feet of the subject property.
Village Attorney Michael Jurusik advised the Board that the zoning ordinance is objective, clear and consistent with state law, and that normal notice procedures (including posting a sign) should be followed. Jurusik recommended mailing notice to property owners within 250 feet of the lot corners for this application.
After discussion about the applicant’s refusal to follow the notice requirement and questions about who pays for notification, the Board voted to follow the Village Attorney’s recommendation. The motion passed with Trustees I. Brandon, M. Jones, A. Sanchez, K. Wellington and N. Booker voting yes and Mayor Edwenna Perkins voting no. Trustee Booker had earlier moved to forward the application to the Board for consideration; that motion also carried.
The board’s decision sets the practical notice range for the application and requires the applicant to meet the attorney’s recommended notification steps before the matter proceeds to a public hearing.
