Council approves Geneva Rock plat, authorizes signature subject to legal review

Craig Flynn, representing Geneva Rock and Cotton Companies, presented a two-lot subdivision plat and an associated infrastructure deferral agreement and said the company will install driveway, curb and gutter and sidewalks now while deferring roadway/asphalt work until adjacent connections are made.

A town planning staff member told the council the plat reflects interlocal coordination with Heber City and Wasatch County and that access for the lots is shown as unincorporated Wasatch County. The staff member said the deferral term was updated to require the roadway connection and associated improvements within 25 years of recordation.

“It's essentially a development agreement…we'll put the driveway in, but in the future, if those roads connect, we've agreed in the next 25 years,” Craig Flynn said, describing the company’s commitments.

Councilors asked staff to confirm that the draft contract on hand reflected the change from 15 to 25 years. The planning staff confirmed the revised draft incorporated the 25-year term in the provisions discussed.

A councilor moved to approve the plat and permit the town administrator to sign the Mylar, with the approval explicitly made subject to legal review. The council voted in favor by roll call (Bennett, Wall, Grady, Rose and Kohler recorded as "yes").

The council's action authorizes the town to proceed with signature and recordation steps once the town attorney completes review. No construction or roadway work beyond the items agreed in the deferral is required until conditions triggering the deferred obligations occur.

The council did not specify an effective date beyond the normal recordation steps; staff said they would circulate the final contract copy to the council and proceed with signature gathering.
