The Auburn Planning Board unanimously approved an application from the Lewiston‑Auburn Water Pollution Control Authority (LAWPCA) to cease operations of the composting facility at 230 Penley Corner Road and accepted the authority’s deactivation plan and environmental monitoring approach.
Staff told the board that the closure was part of a prior approval condition dating to September 2020 and that LAWPCA submitted a deactivation plan, financial estimates for ongoing maintenance while mothballed, and environmental monitoring and remediation measures. Paula Jerun of LAWPCA told the board the facility has not operated for about six years, is currently being maintained (insured, site inspections, mowing and snow removal), and that LAWPCA expects to work with prospective buyers; any new buyer would need to seek separate approvals and comply with DEP requirements.
Board members asked whether deed restrictions and packet materials adequately protect the city and whether responsibilities transfer clearly to a buyer. Staff noted deed restrictions in the packet that prohibit certain uses, require DEP consent for disturbance near a closed biofilter, and limit some redevelopment. Staff also said the authority would remain responsible for site maintenance until a buyer closed and that prospective buyers would have to return to the planning board for site‑plan or special‑exception review for a change of use.
Tim Daroche moved to approve LAWPCA’s application to cease operations at 230 Penley Corner Road based on the December 2025 submission; the motion was seconded and carried unanimously. The board recorded that LAWPCA will continue stewardship until a buyer is in place and that the buyer must obtain any required planning approvals and satisfy deed and DEP restrictions.
