The Kent County Planning Commission voted to grant an extension of final site‑plan approval for a convenience store proposed at 10816 Wharton Road. Planning staff said the developer has delayed construction for market reasons but has recently pulled a demolition permit and contracted a demolition company, and staff recommended granting an extension provided outstanding conditions are met.
Planning staff noted the original approval included conditions such as relocating an ice chest and the propane cage to the area next to the trash enclosure, and the commission’s action maintained those conditions and required submission of sign and lighting details and required sureties for sediment/erosion control, stormwater management and landscaping. The staff recommendation also remains that the developer comply with the county’s ordinance standards.
An applicant representative said demolition permits have been applied for, a demo contractor is under contract and the team will complete the remaining site‑plan conditions before seeking final signatures from planning staff. After questions from commissioners and confirmation there was no public correspondence on the item, a motion to grant the extension passed; one commissioner recorded a dissenting vote.
The commission did not change the previously imposed site conditions and left the required securities and vegetation/erosion controls in place. The developer must submit the required documentation and securities before final site‑plan sign‑off.
