Planning Commission recommends council approve setback variances for home at 3275 County Road 44

The Minnetrista Planning Commission voted Sept. 22 to recommend that the City Council approve setback variances for 3275 County Road 44 to allow a homeowner to tear down an existing house and detached garage and build a new single-family dwelling.
Planning staff recommended approval after reviewing the variance criteria and noting the new house would sit generally in the same footprint as the existing structure. "The public hearing on your agenda tonight is a setback variance," Planning staff said, adding that notices were mailed to properties within 500 feet and no public comments were received.
Applicant Chris Hagen told the commission the project keeps the garage location on the County Road 44 side, will connect the detached garage to the house and will place part of the new house on top of an existing deck. "The new house would be on top of the deck, but about 3 feet in towards the existing house," Hagen said, and he described a corner bump-out that would be roughly 3 feet closer to the water at its nearest point and an 11-foot addition on one side.
Commissioners asked for clarifications about the site plans, an overlay of the existing and proposed footprints and whether removing a lower-tier retaining wall was part of the project. Planning staff said the lower tier to be removed is on the applicant's property and that other higher retaining walls would not be disturbed. A resident asked whether changes would affect drainage; the applicant said drainage patterns would remain the same.
Commissioner (S1) moved and Chair (S2) seconded a motion to recommend that the City Council approve the front-yard and lakeshore setback variances at 3275 County Road 44, subject to findings of fact in the staff report and conditions 1'4. The commission voted in favor; staff said the recommendation will be forwarded to the City Council for final action and is expected to appear on the council's October consent agenda.
The commission's action is a recommendation to the City Council; final approval and any permit conditions will be decided by the council and permitting staff.
