Needham committee adopts trunk/DBH rule to define protected trees

The Town of Needham Tree Preservation Planning Committee on March 18 moved toward a trunk-based rule to identify protected trees, saying a clear, measurable test at diameter‑at‑breast‑height (DBH) will reduce disputes over lot lines.

"If any portion of the trunk at DBH is within the tree yard, then the tree is within the tree yard," the committee summarized as its working definition after more than an hour of discussion and alternative tests. Members had debated a percentage rule (for example, 50/50) but several said that approach would encourage technical challenges and “split hairs.”

The committee rejected a scheme that would require laser measurements or complex percentages in favor of the more straightforward DBH test. Committee members said the DBH measurement is standard practice for arborists and easier to communicate in a public forum and draft bylaw.

Tree warden Ed Volantis and other members stressed that the measurement will be performed and documented on the arborist mitigation plan submitted with a building permit. Chair Klein Porter asked Town counsel (referred to repeatedly as "Chris" in the meeting) to "tidy" the wording so the bylaw and accompanying regulations give the tree warden a clear standard for site decisions.

The decision is procedural rather than final text; committee members said they will ask counsel to draft the precise DBH-language and definitions for inclusion in the bylaw package that will be reviewed at future hearings.

The committee plans to include explanatory slides and simple visual examples at a public forum to illustrate how the DBH rule will be applied and measured.
