The Planning Commission approved special use permits allowing Sunday Company LLC to operate a cannabis cultivation and production facility at 5700 Morgan Mill Road following a change of ownership.
Planner Heather Ferris said the one‑acre property is already developed with cannabis cultivation and production facilities and that division 1.2 of the development standards requires a new SUP when operator or location changes. Staff reviewed compliance with the development standards, found the facility consistent with those standards and recommended approval. Ferris said the original SUPs were approved on Oct. 24, 2018, and that the proposed operation would continue under the prior conditions (about 67% cultivation, 33% production by area).
Commissioners asked about water usage, background vetting, and prior odor complaints. Steven Patek, development engineering, said historical water usage tracked with connection fees and raised no concerns. Ferris said staff contacts the sheriff’s office as part of review and had not received comments on this application; she added background licensing and enforcement happens at the state level. Commissioners noted earlier odor complaints had been mitigated.
Applicant representative Cody Smith said the conditions of approval were acceptable. Commissioners moved and seconded approval of the SUP(s) and the motions carried by voice vote.
Why it matters: The decision permits continuity of existing cannabis cultivation and production operations under new ownership and ensures regulatory conditions are carried forward. Commissioners focused on water use and public‑safety vetting because of the nature of the operations.
What’s next: Sunday Company LLC must obtain and maintain required state licenses and comply with local SUP conditions; staff will monitor compliance as part of ongoing permitting and enforcement activities.
