Delineation dispute stalls 1 Lyman Street NOI; applicant offers invasive‑species cleanup in exchange for waivers

Summary
A disagreement over a wetland delineation 'finger' and its effect on an infiltration basin led Northborough commissioners to continue the 1 Lyman Street notice of intent to May and require a site walk and clearer plans; the applicant offered waivers in exchange for wetland cleanup and a three‑year knotweed monitoring plan.
The Northborough Conservation Commission continued the notice of intent for 1 Lyman Street on April 13 after an extended exchange over a contested wetland delineation and how it affects the proposed infiltration basin.
Engineers and staff described a narrow wetland 'finger' that, if delineated farther into the site, would push required no‑disturb and no‑structure setback lines into the planned infiltration basin and force regrading of the design. Staff said test pits in nearby locations showed non‑hydric soils, but flagged locations near the basin showed hydric indicators and wetland vegetation.
The applicant signaled willingness to seek waiver relief. “If we were to request a waiver from the setbacks, would we be willing to, you know, go by hand into the wetlands and clean up? ... We'd be happy to eradicate [Japanese] knotweed ... and we'd be happy to do that in exchange for the commission entertaining a waiver,” an applicant representative said, offering a three‑year monitoring plan for invasive species and removal of trash as tradeoffs.
Commissioners declined to vote to close the matter without a confirmed delineation and agreed on a site visit and peer review as next steps. Members said they want the revised wetland line shown on the plan before approving waivers or final conditions.
The commission recorded a motion to continue the hearing to May to allow the applicant and staff to arrange a site visit, finalize the revised delineation on plan sheets, and outline any waiver requests with the specific distances they would affect. The continuance was approved by roll call.
