Scott, the library director, said the draft will be sent to the town attorney because state guidance on whether library video constitutes patron records is unclear. He told trustees the policy is intended to permit lawful recording while preventing recording of other patrons without consent. "It says that as a First Amendment auditor, you can tape us, you can tape yourself, but you can't tape another patron while they're in the company," Scott said during the discussion.
Trustees questioned how to distinguish casual amateur photography from professional shoots or surveillance. One trustee raised the concern that someone taking photos could be "scoping the area to do criminal activity," and the board debated whether enforcement belongs in a photography policy or in the library's code of conduct. The group agreed to keep the draft policy focused on typical photography use and to rely on the code of conduct for behavior that appears criminal or threatening.
Scott said staff will work with the town attorney to strengthen policy language where needed and return a revised draft for a future meeting.
