Castle Rock municipal judge flags Colorado Supreme Court ruling and caseload trends

Judge Thor, Castle Rock's municipal court judge, updated the Town Council on court operations and a December 22, 2025 Colorado Supreme Court opinion that, he said, "unanimously held that municipal court penalties could not exceed state penalties for similar offences." He described the decision as recent and significant for municipal practice and said courts statewide are "scrambling" to interpret how broadly the ruling applies.

Judge Thor presented caseload statistics for Castle Rock: an average of about 265 new cases per month, 3,047 new cases in the past year and total dispositions of 3,886 (the higher number reflects carryover cases and warrants); he said roughly 90% of cases are traffic and parking matters with the remainder consisting of animal, criminal and code violations. "This is a very recent development and we're all working through it," he said, and he encouraged council members to observe municipal proceedings to understand court operations.

Councilmembers said they appreciated the update and raised concerns about home‑rule authority and potential statewide changes. Councilmember Brooks referenced legislative efforts (House Bill 241147 was mentioned by number in council discussion) and said municipalities will work through the implications. Judge Thor said he will implement the opinion as he understands it and noted the Colorado Municipal League may provide guidance to municipalities.

The judge offered to answer questions and cited court administration and appointed counsel as strengths in Castle Rock's system. He also described outreach activities such as speaking to a local elementary class.
