The Commerce City Council voted Tuesday to declare two vacant city-owned parcels — 5736 East Washington Boulevard and 5733 Sheila Street — as nonexempt surplus land under California’s Surplus Land Act (AB 1486), opening the first step in a process that prioritizes designated affordable-housing developers.
Community Development Director Jessica Serrano introduced consultant representatives from DelDate, who explained the statutory timeline: a minimum 60-day Notice of Availability (NOA) to the state Department of Housing and Community Development (HCD) and designated entities; a 90-day negotiation window to review proposals and, if proposals are received, an additional negotiation period before returning to HCD for final approval. If no designated entity is selected or terms cannot be agreed, the city may pursue a private sale after HCD approval.
Staff provided parcel details: the two sites total about 2.64 acres (assessor parcel information provided to council), are vacant and sit roughly 0.2 miles from city hall. Serrano recommended council adopt a resolution to declare the parcels surplus and authorize staff to take all actions necessary to comply with the Surplus Land Act.
The council moved and unanimously approved the staff recommendation. Staff will issue the NOA and return with any proposals or further recommendations following the statutory process.
