Nai'ika Allen, standing in for project planner Luis Morales, told the commission the project would include Building 1, a 6,160‑square‑foot convenience store/market with Type 21 off‑site general alcohol sales and two covered fueling areas — "6 pumps for trucks in the rear and a second fueling area consisting of 9 pumps for smaller vehicles in the front," Allen said during the presentation. Building 2 would total 4,883 square feet and include a 2,600‑square‑foot quick‑serve restaurant with a drive‑through and a 2,283‑square‑foot retail space. The site is described in staff materials as a 4.65‑acre parcel (APN 0459‑354‑0405) in the mixed‑use zone.
Staff told commissioners an initial study and mitigated negative declaration (IS/MND) had been prepared and circulated for public review through the State Clearinghouse (State Clearinghouse No. 2023100687; 08/16/2024–09/16/2024). Allen said the project would require frontage and circulation improvements along Air Expressway and Chola Avenue, including curb, gutter, sidewalk and paving, and that separate landscaping plans and other conditions would be required at plan check.
During public questions and staff responses, an on‑phone speaker identified in the record as the applicant said construction would begin "as soon as possible." A member of the public raised traffic concerns, saying Highway 395 "is already only 2 lanes" and asking how large trucks would turn into the site; staff responded that two access points are proposed (Air Expressway and Chola Avenue) and that improvements would be required to the frontage and circulation.
Chair Wagner moved to adopt Resolution No. 24‑11 to adopt the IS/MND and approve CUP 22‑24 and LDP 22‑18; Commissioner Terry Delgado seconded. The commission voted in favor by voice vote; the transcript records the outcome as "Next item passes 4‑0."
