The Tuscarawas County commissioners on April 6 authorized a Phase I Environmental Site Assessment (ESA) under ASTM E1527‑21 for county parcels 25-00854-000 and 25-02314-000 in New Philadelphia.
The board accepted a fixed-fee proposal from Lawhon & Associates, Inc. for $4,300. The firm will review property records, interview knowledgeable persons, inspect the site, review aerial photos and regulatory lists (including National Priorities List, CERCLIS, RCRA, UST/LUST databases) and provide an electronic report in approximately four weeks.
Tuscarawas County Engineer Doug Bachman recommended the assessment; Lawhon's proposal notes that the user (the county) must provide title and judicial-record reviews for environmental liens or activity- and use-limitations and complete an environmental questionnaire to satisfy all-appropriate-inquiries requirements tied to federal brownfields liability protections. The firm also listed additional tasks that would be billed on a time-and-materials basis if requested.
Assistant Prosecuting Attorney Kristine Beard reviewed the proposal as to form. The resolution was moved by Commissioner Pace, seconded by Commissioner Ress and carried unanimously.
