Newark Unified board recesses to closed session on anticipated litigation and labor talks

The Newark Unified School District board recessed a continuation of its meeting into closed session at 4 p.m. to discuss anticipated litigation and labor negotiations, the board’s presiding officer said.

"Members of the public may observe the meeting via the NUSD YouTube channel, live transmission on Comcast channel 26 or in person at the NUSD boardroom," the chair said, adding that Spanish translation was available via Zoom. When asked about public comment, the chair reported, "We do not have any public comment."

The move to recess to closed session was explained as necessary to consider agenda item 2.1 — a conference with legal counsel regarding anticipated litigation under Government Code 54956.9 — and item 2.2, negotiations with the California School Employees Association (CSEA) and the Newark Teachers Association (NTA). The chair stated that agenda items 2.3 and 2.4 were being pulled at the superintendent's request and initially referred to item 2.5 (student expulsion) before correcting that the closed session would cover only items 2.1 and 2.2.

Government Code 54956.9 authorizes school boards to meet in closed session to discuss pending or reasonably anticipated litigation with legal counsel. The board did not disclose further details about the litigation or the specific topics expected to be discussed in the labor negotiations; those matters are typically kept confidential while in closed session.
