Delaware County commissioners approve adding Liberty Lakes Sections 1 and 2 to subdivision drainage maintenance district

Brett Bacon, deputy administrator for the Soil and Water Conservation District, told the board the soil-and-water inspection found the subdivision's stormwater system "in good working order with no major deficiencies." He said the existing retention ponds in Sections 1 and 2 are to be maintained for stormwater drainage only, while aesthetic maintenance remains the responsibility of the homeowners association.
Bacon said the district's current estimate of the stormwater infrastructure value in Sections 1 and 2 is $985,683.78. He recommended adding those sections to the Delaware County Subdivision Drainage Maintenance District so the infrastructure's base value would be included in the district's overall base and assessed at the district's current annual rate of 0.3 mills.
Bacon also explained the timing: Sections 1 and 2 "just barely missed" the county subdivision planning cutoff (they were recorded before July 1998), which is why Section 3 is already on the maintenance district while Sections 1 and 2 were not.
The chair opened the floor to owner testimony in favor and opposition; none was offered, and the clerk confirmed no written testimony had been received. The clerk read Resolution 26-254 "in the matter of finding in favor of the improvement, affirming the order and confirming the assessment for the Liberty Lake Sections 1 And 2 subdivision watershed drainage improvement project." A commissioner moved to adopt the resolution and another commissioner seconded; the clerk recorded the motion as by Commissioner Merrill with a second by Commissioner Lewis.
One commissioner said, "I just think it meets the criteria that we're asked to make these evaluations on," noting the project appeared necessary, would promote public welfare and that costs would not exceed benefits. The board then voted, recording three "Aye" votes and carrying the resolution to add Sections 1 and 2 to the maintenance district and confirm the assessments and payment schedule.
The board closed the brief hearing and noted the next session could not begin until 10:30 a.m.
