Fernley council adopts code changes, approves staff offer updates and appoints acting city manager

Fernley — At its meeting, the Fernley City Council approved multiple staff and land-use items, including two code amendments, a personnel offer-letter update and the appointment of an acting city manager.
The council voted 5–0 to adopt bill 364 (CA 25003), which revises the use standard for home occupations; planning staff said the change codifies prohibited home-occupation categories (for example, 'adult businesses' as defined in code) and clarifies that in-home child care will be handled separately under child-care standards.
Council also voted 5–0 to approve bill 362 (CA 25002), a code amendment to update landscaping and screening requirements for trash enclosures and commercial mechanical and electrical equipment. Planning staff said the changes will add specific location, height and material standards to ensure consistent enforcement; they noted the new rules apply to future development and not to existing buildings unless changes are proposed.
On staffing matters, City Clerk Kim Swanson asked the council to add a six‑month severance provision to her offer letter; Councilman Torres moved and Councilman Mendoza seconded approval, and the motion passed 5–0.
Utilities Director Sung Kim requested reclassification of an administrative specialist to a utilities project coordinator to reflect the employee’s higher level of project-management work. Councilmembers asked for the union language and a clean contract reference before approving the change; the council voted 5–0 to return the item to a future agenda with additional documentation and suggested language.
The council appointed Lydia Altek as acting city manager for the recruitment process for a new city manager; the appointment passed by roll call (vote announced as 4–1). Mayor McIntyre said the council will provide updates on the CPS HR recruitment process separately.
On ordinances, staff introduced bill 369 (derived from AB 375), which would allow restaurants licensed for on-premise alcohol sales to sell sealed alcoholic beverages for off-premise consumption via third-party delivery platforms. Staff recommended training requirements for delivery drivers and limiting deliveries to hotels, motels and RV parks for responsible service; council discussion focused on what constitutes a "sealed" container and the statutory surcharge for DUI prevention. The bill will return for a second reading and possible adoption on Oct. 1.
