Summary
The board adopted Resolution 20260401R to put Indiana Code 5-23 (public-private agreement authority) into the city's procurement toolbox, enabling RFQs and build‑operate‑transfer approaches if the city later elects to pursue them.
At the April 15 meeting, the Crown Point Board of Public Works and Safety adopted Resolution 20260401R, which the city attorney said formally adopts Indiana Code 5-23 — the state statute authorizing public-private agreements and build-operate-transfer tools — so the city may move forward with RFQs and similar procurement processes if a project warrants that route.
Alex, who drafted the resolution pursuant to the statute, told the board the City Council had already acted on the measure at its previous meeting and that the Board of Works' action completes the municipal adoption step. “We drafted this pursuant to the statute of Indiana code 5-23,” Alex said. The mayor said the city has considered the tool in the past and several neighboring communities have used the statute for construction projects.
The board approved the resolution by voice vote. The action does not obligate the city to pursue a public-private project; it only authorizes the city to use that procurement tool in the future if an appropriate project arises.
