Council grants second extension for Homestead Resort conservation easements until Oct. 1, 2026

The Midway City Council on April 7 approved Resolution 2026-07 extending the deadline for recording required conservation easements on Open Space Parcels 1–7 at the Homestead Resort until Oct. 1, 2026.
Planning Director Michael Henke reviewed the history: the easements are a condition of the Homestead Resort master plan and one extension had previously been granted. Henke told the Council he thought the easements should be recorded by October but that there were no formal numeric limits on extensions. Lauren Bolger of Hoffman Law, representing the Homestead Group, said existing loans were subordinate to the easements and that lenders were not moving quickly; Bolger requested more time to complete several buildings and reduce loan amounts so the easements could be recorded.
Council Member Andy Garland moved to approve the second extension through Oct. 1, 2026; Council Member Kevin Payne seconded the motion. The Council recorded Aye votes from Garland, Orme, Osborne, Payne and JC Simonsen and approved the resolution. The minutes note the amount of open space would not be reduced and that lenders’ timelines were the primary reason for the applicant’s request.
The extension grants the Homestead Group additional time to satisfy the recording requirement; the Council’s approval sets the new deadline at Oct. 1, 2026.
