The Elko City Council voted Sept. 9 to accept a parcel offered for dedication and to require a performance agreement for Copper Trails Phase 3 Unit 1, a residential subdivision brought forward under an existing development agreement.
Planning staff said the proposal is in conformance with the master plan and transportation components and described modified lot standards to allow smaller lots (staff reported lot widths around 40 feet and depths about 80 feet; minimum usable floor area was listed at 1,200 square feet). The staff report noted a portion of the property lies within a 30‑year groundwater capture zone and set multiple conditions for final approval, including performance and maintenance guarantees and a substitution option for riprap stabilization subject to staff approval.
During the motion to approve, one council member declared a significant pecuniary interest and abstained, stating they are the broker/owner of a local realty firm and are associated with a construction licensee that might list homes in the subdivision. Council accepted the dedication and approved the final map subject to the staff report conditions and execution of the required performance agreement within 30 days of council acceptance.
Conflict of interest and technical details were on the record: the council member said, “I have to abstain from this motion… I am the broker owner of Lost Realty,” and the abstention was recorded before the final vote.
What’s next: the developer must complete the performance agreement and install required improvements per the city code and the planning staff’s conditions before final platting and building permits proceed.
