Council ratifies settlement with Union Pacific, approves filming closure, liquor license and code changes

The Elko City Council addressed a set of largely procedural votes and permits at its Nov. 12 meeting.
Union Pacific settlement: Staff reported the mayor had already signed a settlement and mutual release resolving the City's reimbursement claim for Water Street repairs after a 02/28/2024 derailment; the city had received the check and council voted to ratify the executed settlement and release.
Filming closure: Council approved a request from Jeremy Muth (Atlas Towing & Recovery) to partially close the intersection of BFW Drive and Silver Street for several hours on Nov. 16 to film a staged nonflammable crash for a Reality Network production; the applicant will provide signage and pay the $100 closure fee. Producers invited council and the public to a meet-and-greet on Nov. 18.
Liquor license: The police chief reported a satisfactory background investigation for applicant Ryan Stevens (Smokey Vibes LLC, 588 Commercial St.) and council ratified a 26-day temporary package liquor license and a regular package liquor license.
Ordinance adoption and right-of-way vacation: Council conducted a second reading and adopted Ordinance 906 updating administrative building regulations (including a change to inspection request deadlines) and adopted Resolution 20-25 vacating approximately 729 square feet of Sage Street right-of-way to allow an off-street parking pad for a duplex conversion; staff said the variance passed planning commission with no public comment.
Votes on these items were carried on voice votes; council reviewed related documentation on the record and directed staff to complete ministerial steps for execution and notice where applicable.
