Lake Placid council delays decision on 7 South Main parking waiver amid downtown parking concerns

Town planner Dana Riddell presented a staff recommendation to approve LPTCDot26Dot003 — a reduction in parking requirements for a change of use at 9 South Main from retail to an eating and drinking establishment. Riddell said the storefront has three on‑site spaces and the change of use would increase the requirement to 12, creating a shortfall of nine spaces; a two‑week parking study within a one‑block radius showed roughly 84.29% availability over the study period.

Councilmembers and residents questioned whether the adjacent yellow‑shaded spaces are private, liability if the owner opens private spaces to the public, and whether granting a variance would unfairly affect businesses that previously received variances. The applicant described the planned operation as a bakery with primarily grab‑and‑go service and "6 chairs in there" for limited seating and quick turnover. Public commenters urged a long‑term downtown revitalization approach; one resident proposed creating a mitigation fund paid by variances to acquire and develop public parking.

After discussion and legal counsel’s guidance about the quasi‑judicial nature of the decision, Councilmember Greg Sapp moved to table the request until the following Monday so staff could pursue further discussions with the property owner and confirm legal and insurance implications; another councilmember seconded. The council took a roll call vote and the motion to table carried; the item will return for further consideration at the next meeting.

Council asked staff to explore options including a mitigation fund for future parking needs, to check whether private parking can be made publicly available, and to coordinate the item for a Monday meeting if practical.
