Council pauses consideration of Vialytics pilot after JIF raises Title 59 immunity concerns

The city’s Joint Insurance Fund (JIF) reportedly advised caution, raising questions about whether accepting Vialytics’ findings would create obligations under Title 59 to promptly remediate identified deficiencies to retain immunity from liability.
Bucci said the JIF had recommended taking additional time before action. “They referred to Title 59 immunities and our inability to claim immunity if deficiencies aren't addressed promptly,” Bucci said, and she recommended holding off while the JIF and city staff review the implications. Solicitor Facenda summarized the JIF’s position as a recommendation to pause consideration rather than an instruction to terminate review.
Council did not take any formal action to adopt or reject the Vialytics program during the work session; members asked staff to follow up with the JIF and report back with additional detail on liability implications and any possible contractual protections.
