Commissioners advance charter ethics overhaul to study committee after questions on staffing and authority

Commissioner Gaskay presented amendment 26-15 to expand Clark County’s ethics framework by establishing minimum local ethics requirements, broadening disclosure and training standards, strengthening detection and correction tools, clarifying the independence of the ethics commission, and staffing the office of oversight.

Gaskay said the proposal focuses on prevention (training and disclosure), detection (broader authority for an independent commission) and correction (investigatory and removal procedures). He proposed that community organizations nominate candidates, with appointments made by the council, and that the commission have authority to self-initiate investigations while investigations would be carried out by a staffed office of oversight.

Commissioners praised the goal of raising ethical standards but raised several concerns: who would staff the oversight office and pay for it; the scope and safeguards for proactive investigatory authority; whether volunteer commissioners could sustainably perform training duties; and whether jurisdiction should extend to contractors, vendors and lobbyists. Gaskay said safeguards, removal procedures and penalties for frivolous complaints would be included in the code and that the office should be staffed as originally intended by prior charter language.

After discussion the commission voted to advance amendment 26-15 to study committee (12 ayes, 2 nays, 1 abstain). Committee membership and chair were confirmed.
