Council transfers ownership of costly roundabout sculpture back to developer‑donor under agreement, 6–1

The council approved agreement 26307 to transfer ownership and maintenance responsibility for a donated kinetic sculpture at the 135th Street roundabout back to the original donor, Woodin Creek Village Associates, after staff reported major mechanical failures and estimated repairs north of $115,000.

Staff said the sculpture was donated to the city in 2017 and the city assumed maintenance obligations; after years of light upkeep, major mechanical components have failed and repairs would exceed $115,000. The agreement presented would relinquish ownership to Woodin Creek Village Associates while allowing the artwork to remain installed on public property, with the private owner required to provide notice before any removal.

Council members noted the option represented a pragmatic tradeoff: the city avoids a large repair bill while preserving the public display if the owner maintains the piece. Council moved and seconded the agreement substantially in the form presented and authorized the city manager to effectuate it; roll call recorded six votes in favor and one opposed. Council clarified that if the private party removed the sculpture the existing agreement would require notice to the city and that the city did not have an option to immediately reassert ownership without terms spelled out in that agreement.

With the vote concluded, staff will continue to work with Woodin Creek Village Associates to finalize the transfer paperwork and ensure the notice provisions and any display conditions are included in the final agreement.
