The subcommittee also considered exactly how testimony should be sworn. Regarding oaths and affirmations, Sanders explained the difference and recommended keeping both options so witnesses may "swear an oath or an affirmation" in line with their beliefs. "I think both oath or affirmation covers that," Sanders said.
A central procedural point addressed the standard for finding a violation. The draft requires that the vote to find a violation be made by a minimum of seven of the nine voting members who are present and qualified to vote; Sanders clarified that the requirement for a unanimous finding applies to those members present and qualified, not the entire nine-member body. Members discussed whether subsequent implementation steps should be chosen by majority vote after a finding.
After cleanup of formatting and language, the subcommittee voted to forward the revised Rules of Procedure to the full Ethics Committee for consideration. The committee also asked staff to tidy flowcharts and formatting before that presentation.
Next steps: staff will refine the flowchart and formatting; the revised Rules of Procedure will be placed on the full Ethics Committee agenda for a vote.
