Zoning Officer Dave Yefko and Borough Administrator Sondra Riviello presented a stormwater-waiver request from the JCC at the Feb. 16 council meeting, saying the proposed accessory structure is not a land development but must comply with Kingston's Stormwater Management Ordinance unless Council grants waivers.
Yefko said the application reduces impervious area and that the Borough engineer and Planning Commission support granting the waivers; he also referenced an e‑mail from borough engineer Nick Argo backing the change. Because the exception is treated like a land development for waiver purposes, Yefko said Council must approve any waivers by resolution and that zoning permits will be held until Council acts. He noted the Conservation District does not require a soil‑erosion submission for structures under 20,000 square feet and that the JCC does not exceed that threshold.
Yefko told council the waivers could be voted on March 2 and that he would wait to issue zoning permits until Council accepted the waivers. Council did not act on the requests on Feb. 16; staff and the Planning Commission recommended the waivers be granted at the next appropriate meeting.
