Greeley County approves road‑use, decommissioning and indemnity agreements with Greeley Wind Nebraska

The Greeley County Board of Commissioners on Feb. 11 unanimously approved a package of agreements with Greeley Wind Nebraska, LLC that the county said formalize how the project will use county roads, ensure decommissioning of facilities, and assign indemnity responsibilities.
County Attorney Cindy Bassett and counsel read the agreements into the record at the meeting and explained the documents incorporate the Findings of Fact and Conditions of Approval issued by the county on Aug. 8, 2023. The Road Use and Maintenance Agreement specifies design, permitting and material responsibilities for crossings and requires closure of affected roads during certain work; the Decommissioning Agreement relies on an Exhibit A Decommissioning Plan prepared by Kimley‑Horn; the Indemnification Agreement allocates legal responsibility if claims arise.
Board members moved and seconded approval of each document in sequence. Commissioner Dennis Wadsworth moved to approve the Road Use and Maintenance Agreement; Commissioner Joe Leslie seconded. The board then approved the Decommissioning Agreement and the Indemnification Agreement by the same unanimous roll‑call vote. Chairman Jordan Foltz confirmed the agreements defer to the August 2023 Findings and Conditions in case of a conflict.
Planning & Zoning Administrator Trevor Nekoliczak had earlier advised the board that survey outreach and public input were underway for related county planning tasks. The board did not adopt additional conditions at the Feb. 11 meeting and did not amend the incorporated Findings and Conditions.
The board’s action completes the county’s formal consent to the three contract documents described at the meeting. The agreements were approved by roll call (three ayes).
