Summary
The council unanimously adopted ordinance No. 10933 to amend the city code to allow enforcement measures when public servants (police, fire, code, public works) face interference at major scenes, at the request of the fire chief.
The Winnsboro City Council unanimously approved ordinance No. 10933, amending section 5.01 0.001 of the city code to expand enforcement options for interference with public duties.
Miss Lyons told the council the change originated from a request by the fire chief to allow enforcement measures at major scenes so responding public servants (police, fire, code enforcement and public works) can ask people to leave unsafe scenes. "This originally came from ... a request from our fire chief," Lyons said, explaining the amendment would extend protections citywide for any major scene.
Council members discussed how the update relates to the Texas Penal Code. One council member observed, "Our current code is from 1997 and explicitly just protect fire department personnel the way we have it now; it is more in compliance with penal code that says any public servant is protected." After brief discussion, a motion to adopt ordinance No. 10933 was made, seconded and approved by the council.
The council recorded the motion and its passage in the meeting minutes; the transcript shows the ordinance passed during the meeting with no dissent recorded.
