Jacob Lund, community planner, presented the request and described steep lot slopes, a 25-foot water easement and drainage easement on the parcel, and how elevations on the proposed garage approach but do not exceed the requested 25-foot height. Lund said staff reviewed the application under LDC section 9.13, found it in conformance with review criteria, and noted a precedent variance in the same neighborhood that allowed a 27.5-foot structure.
Staff reported two written oppositions: one nearby neighbor concerned about drainage and another expressing concern about precedent for taller structures. Lund said drainage issues will be examined during the building-permit review by public works.
Board member Tom Hutchison expressed concern that the proposed plans show electrical and plumbing capacity that could facilitate conversion of the garage into secondary living quarters. Lund said the submitted floor plan showed no bedrooms and that converting to a residence would require separate permits and could constitute a zoning violation; staff also said a condition restricting rental or guest-house use could be considered but might not be appropriate as a condition of variance approval.
Miriam Habrick moved to approve V26-002 and Tom Hutchison seconded. The motion passed 4-0.
The variance approval authorizes the requested height; building permit review will address drainage, structural and plumbing/electrical compliance, and any modifications required to prevent unauthorized residential use.
