Assistant City Manager Martin presented a comprehensive recodification of Title 7 of the Laguna Niguel Municipal Code, saying the update is meant to bring the city's highways, right-of-way and vehicle rules into alignment with current state law and modern editorial standards. “This project aims to complete a comprehensive update to the city's municipal code since it hasn't been updated since original adoption, resulting in a code that is inconsistent and outdated with current state law and actual city practices as well as in meeting modern code formatting and editorial standards,” Martin said.
Martin said the contractor American Legal Publishing completed a technical and editorial analysis and staff worked with the city attorney to refine the draft. He identified two classes of changes: nonsubstantive editorial fixes and targeted substantive updates specific to Title 7. Among the substantive revisions, Martin said the draft removes obsolete bus-shelter rules tied to a prior program—because a current shelter replacement project will transition shelters to city ownership and maintenance—and replaces references to an outdated city traffic manual with Orange County public works standard plans to ensure regional consistency.
The draft also adds financial protections when private parties perform road work, Martin said, including surety-bond requirements and warranty language for excavation and improved roadway areas. It deletes fixed dollar amounts and percentage caps that had become outdated so required fees more accurately recover actual costs. To reduce piecemeal repairs that undermine pavement quality, the update raises resurfacing requirements for others working on city roadways, Martin said.
Other changes clarified parking and vehicle restrictions, including additional restrictions on overnight parking and improved definitions that align with California statutory language and the California Vehicle Code. The draft would also allow the city manager to delegate street closures for events such as the holiday parade and the Sea Country Festival.
Martin closed by noting remaining work on other code titles, saying title 8 (building regulations) is scheduled for April 21 and that full recodification remains on track for August. The mayor opened public comment and the city clerk reported there were no public speakers on this item.
The presentation was informational; council took no formal action on Title 7 during the meeting.
