The Boulder City Council voted to reverse the Planning Commission and approve two variances requested for a property at 3 Linda Lane after a public hearing and site visit June 3.
Community Development Director Michael Mays explained the application seeks variances for a principal structure height 10 inches above code and an accessory garage height 3 feet, 3 inches above the maximum. The Planning Commission denied the variances 5–2; property owners appealed that decision to council. Applicant Tom Martins described the steep lot constraints and the design choices made to avoid large retaining walls.
Councillors cited the parcel’s steep slope and limited buildable area as extraordinary circumstances justifying the variances and found no adverse impact on neighbors given the lot’s isolation and grade differentials. Council tied approval to the five findings listed in the staff report and voted to reverse the Planning Commission’s action.
