Euclid City Council voted Tuesday to request a hearing on two alcohol-permit applications for People Enterprises LLC that would extend operating hours and allow Sunday sales.
The move came after Law Director Cooney told the council the city received applications for an AD5 permit, which allows sales until 2:30 a.m., and a D6 permit, which permits Sunday sales. "It would be the administration's recommendation that council again request a hearing with respect to these 2 permit classes," Cooney said.
Councilman Hanham raised concerns that the company's earlier statements to council had indicated a closing time around 10–10:30 p.m. "Receiving this application saying that they wanted to sell alcohol until 02:30 in the morning seems to go against what we were told as a council," Hanham said, urging the council to seek a hearing because of "too many questions" about the site and its history.
A council member asked when the hearing would be scheduled; Cooney said the Division of Liquor Control, not the city, sets hearing dates and would notify the city when one is set.
Chair called for a motion; the motion to request a hearing was made and seconded and the clerk recorded the vote. The chair declared the motion to request a hearing passed.
The council did not take further legislative action on the permits at the meeting; the Division of Liquor Control will notify the city of the hearing date when scheduled.
The council's action was procedural: it asks the state agency to hold a formal administrative hearing so that the council and public can review the permit requests and offer testimony. The hearing will be the venue for final determinations on the permit requests.
