At a Nov. 23 meeting the Greeley County Board of Commissioners voted to remand two related matters concerning Wlaschin Cattle, LLC back to the county Planning & Zoning Commission for additional review. The matters were a Special Use Permit application for a large animal feeding operation and a petition to amend the county zoning ordinance related to waivers for confined animal feeding operations.
Attorney Steve Mossman, representing Wlaschin Cattle, argued that the petition to amend the zoning ordinance may not have been properly advertised for the Planning & Zoning hearing. Franz Trumler, the Planning & Zoning Administrator, told the board he felt the hearing had been rushed and recommended additional time for review. Ken Ryan, P&Z chairman, told commissioners that the Planning & Zoning board was confused by the order and process at the public hearing and needed more time.
Following discussion the county board voted 2–1 to return both items to Planning & Zoning for more complete consideration (Goldfish yes, Foltz yes, Leslie no). The board’s action preserves the right of the Planning & Zoning Commission to reconvene, re-advertise if necessary, and provide a clearer factual record before the county board takes a final action.
The minutes record no final decision on either the Special Use Permit or the zoning amendment; both matters were returned to the administrative hearing body for further process.
