Council adopts CFD formation resolutions for Las Palmas, adds language excluding developer defects from CFD spending

Jurupa Valley’s City Council on Dec. 18 voted to adopt resolutions forming and financing a Community Facilities District (CFD) for the Las Palmas development and then introduced a related ordinance. The measure, which the clerk said had one ballot cast in favor, establishes a special‑tax mechanism to fund maintenance and public facilities associated with the subdivision.

During the public hearing and subsequent council discussion, Councilmember Carmona pressed staff to tighten the CFD’s descriptive language to ensure that the district’s special tax could not be used to pay for defects caused by developer design or construction. City legal counsel and public‑works staff told the council the CFD is a maintenance‑funding mechanism but that construction‑phase agreements and bonds already in place require developers to assume responsibility for design and construction defects; staff agreed to add explicit language to the CFD resolutions and to examine making that standard language for future CFDs.

The council approved the resolutions (recorded in the minutes) and directed staff to add the following clarification to the description of authorized services: the CFD’s special tax shall not pay for defective design or flooding caused by the developer.
