Commission approves Milligan wellhead protection ordinance amendments

On Nov. 28 the commission approved amendments to Milligan’s zoning ordinance (sections 5.11.07 and 5.11.09) strengthening wellhead protection rules and adding conditional‑use review requirements for hazardous materials and certain livestock expansions near wellhead areas.
At a Nov. 28, 2016 public hearing the Fillmore County Planning Commission considered revisions requested by the Milligan Village Board to the village zoning ordinance related to the Wellhead Protection Overlay District. Proposed language additions clarified that commercial or industrial uses that utilize or store hazardous materials (including petroleum products, agricultural chemicals, anhydrous ammonia or other fertilizers in excess of 50 gallons) may be regulated by conditional‑use permit, and added municipal review and specific conditional‑use provisions for livestock confinement expansions within the overlay.
The commission closed the hearing and approved the recommended amendment by unanimous vote. The minutes record proposed text and the commission’s recommendation to adopt the changes, which include coordination between the Milligan zoning administrator, planning commission and governing body for reviews and conditional‑use permitting near wellheads.
Next steps: the amended language will be incorporated into the Milligan ordinance and conditional‑use procedures applied to future permit requests within the overlay area.
