City approves encroachment agreement for 702 Beach Street, limits future changes to written mutual agreement

Clara Beck explained the agreement cleans up an existing nonconformity for the former candy shop now used as a residence. She said the draft presented to council will be revised before Monday’s meeting to change the insurance requirement from general liability to personal liability, remove the workers’ compensation section, and alter a provision so that new homeowners must provide insurance documentation "upon request" rather than at every ownership change. "It's cleaning up this existing, nonconformity...the section that you'll see, changes to is the insurance section number 7," Beck said.
Councilmembers asked whether the encroachment would prevent future street-widening. Beck said any change to the encroachment agreement would require discussion and written changes by both parties. The homeowner, Mr. Herman, confirmed the edits were those he wanted. The council approved the agreement by voice vote and placed it on the consent agenda.
