Goochland supervisors approve contingency funding for outside counsel in TOD litigation

County Attorney Ms. McGee told the board the attorney's office provides legal advice across many county functions and that defending the county in complex land‑use litigation requires specialist attention: "Our office does engage in defending the county in litigation," she said, noting the legislative record in this case is unusually large and that outside counsel has historically been used when matters exceed in‑house capacity.
Ms. McGee said the county carries insurance that provides defense counsel in many cases, and staff will rely on that coverage first. She described the requested transfer as contingency for "an unforeseen expense" to ensure the county can mount a full legal defense if insurance limits are reached or outside expertise is needed.
Residents who addressed the board during citizen comment urged more transparency and objected to committing taxpayer dollars without public discussion. One speaker said a promised Parkside Village water survey was never conducted and asked, "If you can't afford 200 stamps, how can you possibly afford a quarter of $1,000,000 on a law firm to defend against alleged illegal actions in creating the technology overlay district?" (public commenter).
Supervisors acknowledged the public concern but several said outside counsel is a standard and prudent practice for specialized litigation. A motion to approve the transfer and appropriation for outside counsel passed by the board.
The board's action was procedural: staff said insurance funds will be used when available and the appropriation from unassigned funds is intended as a backstop. No settlement or legal outcome was announced; the action simply made contingency money available to support the county's legal defense going forward.
