The Town of Babylon Planning Board heard an application to change the zoning of a split-zoned lot at the northeast corner of Gilbert Place and Overland Avenue in Amityville so the owner, Stanley Gilpin, can build a two-story, single-family dwelling.
Nicole Blanda, the applicant’s attorney, said the lot is 7,520 square feet with 60 feet of frontage and is currently vacant. She told the board the owner seeks rezoning from Business E/Residence B to full Residence B to allow construction of a two-story house with four bedrooms, two-and-a-half baths, an internal garage and a basement. “We consent to all of the conditions, and we consent to all the covenants,” Blanda said, adding the owner will comply with restrictions requiring single-family, owner-occupied occupancy and prohibiting accessory apartments.
Blanda said the project was revised to avoid needing a building-area variance: “Originally, there was a larger front porch. We now have a smaller…in order to comply fully with the zoning code,” she said. The applicant also proposed a 6-foot white PVC fence along the rear and side property lines and a 5-foot landscaped buffer with a single row of 8-foot-high evergreens on the east side and rear.
Board members asked clarifying questions about whether any variances were needed and why the porch had been reduced. The applicant reiterated no variances will be sought and said the parcel’s “single and separate” status allows it to use the existing, smaller frontage and lot-area dimensions accorded that classification.
After discussion, the board voted to close the public hearing and reserve decision so staff can review written comments and any outstanding site issues. Chair Patrick Halpin announced that application documents and plans are available for inspection at the Planning Department during business hours and that the record will remain open to accept written comments.
The public hearing was closed on a motion by Jerry and a second by Ed; the board approved closing the hearing and reserved its decision pending further review and the receipt of written comments.
