Council declines to grant conditional-use permit for Century 21 sign in historic shopping district

The property owners and tenant described the office as locally owned and operated, not a uniform national chain, and argued the use would preserve the building’s character and provide low-impact services to Main Street.
Staff reviewed the application and recommended approval, noting the building’s adaptive reuse and compatibility with neighboring uses. Planning & Zoning, however, recommended denial based on its interpretation that the franchise met the definition of a standardized business and previous precedent denying similar requests.
During the council’s public hearing, multiple proponents (including building owners and a longtime Historic Review Board volunteer) said the office is locally run, has limited foot traffic and preserves the historic façade. Staff explained the P&Z recommendation process and the four affirmative evaluation criteria (alteration of character, detracting from uniqueness, contribution to standardized national trends, impairment of the ordinance’s intent) the body must weigh under Section 5.461 of the zoning code.
A motion to overturn P&Z and grant the CUP required a supermajority under the code. The council conducted a roll-call vote; after tallying votes the motion did not achieve the required supermajority and ultimately failed (transcript records the motion to overturn as failing 3–2). The denial stands and the applicant may pursue an appeal or reapply under applicable procedures.
Mayor Gerald Hoover noted the long history of debate over standardized business rules in Fredericksburg and cautioned that past council decisions influenced the current planning framework. The council’s decision preserves the Planning & Zoning Commission recommendation.
