The council opened a public hearing on the request and received no oral testimony. Planning staff had forwarded a recommendation of approval from the Planning, Programming and Zoning Commission. "This easement vacation gives the applicant authority to use the site as proposed; it does not obligate the city to spend additional funds," said Noel Anderson, Community Planning and Development Director.
Council moved to suspend the rules to consider the ordinance beyond first reading. After a roll call, the council considered and passed the ordinance for its second and third readings and adopted it the same evening. The city authorized the mayor and city clerk to execute the contract documents associated with the action.
The ordinance clears a local land‑use step for the property owner; council members had no public objections during the hearing and voted to adopt the measure. The matter will be reflected in the city's recorded documents once the clerk publishes the required notice.
