ZBA recommends 3-foot rear-setback variance for Sun City addition at Lehigh Street

The Village of Huntley Zoning Board of Appeals on Aug. 28 voted 7-0 to recommend approval of Petition No. 23-08.02, which would allow homeowner Terry Nichols to construct an approximate 11-by-13-foot single-story room addition that encroaches about 3 feet into the 20-foot rear setback at 13389 Lehigh Street in the MF-2 AR PDD district. The board’s recommendation includes a condition that no building permits or Certificates of Occupancy be approved as part of the Simplified Residential Zoning Variation.

Senior Planner Scott Bernacki presented the petition and noted the addition would not affect side setbacks or the 10-foot rear easement; he also reported the Sun City Homeowners Association had conditionally approved the proposal. The petitioner’s contractor, Adam Kingan, told the board his company has completed about 50 sunrooms in the Sun City neighborhoods and said neighboring property owners had not objected to the plan.

Board members asked about HOA documentation and placement of the addition. Member Dennis O’Leary confirmed that the documentation submitted to the HOA overlapped with the petition materials and said he had no further objections given HOA approval. Member Ron Hahn reiterated that there are no rear neighbors to object. Member Ron Hahn moved and Member Joseph Holtorf seconded the recommendation to approve subject to the staff condition; the motion carried 7-0-0. The recommendation will be forwarded to the Village Board for final action.
