Deuel County zoning board greenlights kennel after owners reduce capacity, add fence

The Deuel County Zoning Board on March 9 approved a previously invalidated kennel permit, contingent on changes intended to limit noise and off-site impacts.
The board voted to approve Building Permit #25-0043 after owners Craig and Darla Jelen presented a revised site plan that reduced the kennel building footprint, relocated some outdoor runs, and replaced a planned 9-foot sound wall with a six-foot solid steel fence around the outdoor area. The board required a revised Letter of Assurance reflecting reduced capacity and defined outdoor-run hours.
The board’s action followed discussion about barking and management practices. The Jelens told the board that dogs would be supervised when outdoors, monitored by cameras with audio capability, and would not be left outside overnight. Board members discussed enforcement options and the role of camera footage in resolving complaints.
Neighbor Jacob Beutler told the board he was concerned the revised layout differed from what had originally been approved and urged strict enforcement of the Conditional Use Permit conditions. Another resident, Roger Cutshaw, said dogs had been heard occasionally but not continuously from his property.
Under the approved conditions the maximum number of adult dogs allowed at the facility was reduced from 40 to 30. Outdoor runs are limited to hours between 7:00 a.m. and 9:00 p.m., with brief potty breaks allowed outside those hours. The applicants must enclose the outdoor kennel area with a six-foot solid fence and provide camera footage to the board if a barking complaint is filed.
The motion to approve the kennel as built with those contingencies passed on a 4–1 vote: Jay Grabow, Dennis Kanengieter, Kevin DeBoer and Mike Lammers voted in favor; Chairman Mike Dahl voted against the motion. The approval follows the board’s earlier invalidation of the permit on Feb. 11, 2026 and came with the explicit condition that the applicants sign the amended Letter of Assurance.
The board recessed the Board of Adjustment and reconvened as the Planning Commission before later resuming joint session.
