The Planning Commission approved a plan amendment for 1514 Rigsby Avenue on Jan. 28, 2026, clearing the way to rezone the site from Neighborhood Mixed Use to Community Commercial and to seek a C-2 CD zoning designation with a conditional use for motor vehicle sales.
Alexa Ratana, planner with Development Services, told the commission staff found the proposed land‑use change “inconsistent with the surrounding area,” noting the request would remove residential zoning options and introduce higher‑intensity commercial uses adjacent to single‑family homes. Ratana reported staff mailed 38 notices, with five in favor within 200 feet and no opposed responses within that radius.
Elizabeth Russell, attorney for the applicant, said the property and the surrounding two‑block area have a long history of mixed commercial, industrial and residential uses and asked the commission to allow the owner to use the property for used car sales. “My client is wanting to utilize the property as it has historically been used,” Russell said, adding the site has had a yellow metal building for many years and that the owner would follow required permitting steps, including a board of adjustments for setback nonconformities.
Commissioners pressed the applicant on operational limits. Russell said, “The only make ready will be oil changes, nothing more extensive than that,” but agreed to eliminate oil changes if the approved zoning would not permit them. Staff clarified that a C-2 CD approval for motor vehicle sales would not permit oil‑change operations in the Salado Creek Watershed and advised the applicant to plan accordingly.
Commissioner Siegel moved to approve the plan amendment and rezoning with the conditional use for motor vehicle sales; Commissioner Milam seconded. Staff conducted a roll call vote; the motion passed with recorded affirmative votes from Siegel, Milam, Sanchez, Lopez, Litt, Bustamante, Prophet and Chair Peck.
Next steps identified by the applicant include applying for required zoning approvals and, if necessary for nonconforming setbacks, pursuing relief through the board of adjustments.
