The City of Edgerton Common Council voted unanimously Oct. 6 to accept an offer for Lot #2 in the Edgerton Business Park, contingent on Council approval of a Development Agreement with Basement Repair Specialist. The motion to accept the offer was moved by Tim Shaw and seconded by Candy Davis and passed on a 6–0 roll call vote.
City Administrator Ramona Flanigan told the council that a developer identified in the minutes as Kevin Hendricks had expressed interest in purchasing two lots in the business park and in building on them; the minutes also record the name later as "Kevin Kendricks." The minutes state the purchase agreements for the two lots were discussed in closed session and that the land sale would be linked to the N. Main Street project. The council earlier approved a land sale agreement for two lots (motion Tim Shaw/Shawn Prebil) on a 6–0 vote; after returning from closed session the council moved to accept the offer for Lot #2 specifically, contingent on a development agreement with Basement Repair Specialist.
The council invoked the state closed-session statute before finalizing the matter; the minutes cite the statutory basis for the closed session as Wis. Stat. 19.85(1)(e) (deliberating or negotiating the purchase of public properties when competitive or bargaining reasons require a closed session). The motion to enter closed session was moved by Tim Shaw and seconded by Jim Burdick and passed 6–0; the council later voted 6–0 to return to open session.
The minutes do not specify sale price, buyer contact details, or the full terms of the proposed Development Agreement. Council documents or the city clerk's office may provide the formal purchase agreement and the Development Agreement when they are presented for approval. The acceptance of Lot #2 is contingent on council approval of the Development Agreement; no further timeline for that approval was recorded in the minutes.
