The San Anselmo Planning Commission on March 16 voted to recommend ministerial amendments to Title 10 of the municipal code to the Town Council. Assistant Town Attorney Emily Longfellow presented the brief package as technical cleanups to the land-use regulation table and associated notes.
Longfellow described three specific changes: removing wording in a table note that could be read as requiring owner occupancy where 20% affordable units are present; clarifying a mixed-use development note to say it remains subject to state law when applicable; and adjusting the town's approach to fractional ADU allowances so that, where 25% of units yields a fraction, the town rounds up to the next whole unit, consistent with interpretation under state density-bonus rules.
"We just need to make it clear that there is no owner occupancy requirement," Longfellow told commissioners. She said the ADU rounding change is not legally required but aligns the town with how state law treats fractional unit calculations and could help the town meet housing goals.
There were no public comments on the item. After brief discussion, the commission moved and seconded the recommendation and approved it by voice vote for transmittal to the Town Council.
