Staff says DNR negotiations ongoing on shoreland ordinance updates; lot size and impervious surface may be negotiated

City planning staff told the planning commission that the Minnesota Department of Natural Resources has engaged with the city on shoreland ordinance updates and that some technical standards are negotiable.
James said staff held two meetings with DNR representatives and that the DNR indicated the city can negotiate lot sizes and impervious surface allowances provided compensating concessions are made elsewhere in the ordinance. Staff also reported the DNR’s suggestion to add stormwater management plans for properties that exceed normal thresholds. James said the city will need to add lot requirements for duplexes, triplexes and fourplexes (these will be larger than prior lot‑size tables) and that some provisions may require increased restrictions to meet state expectations.
Staff said the DNR indicated certain districts (for example forested rivers PSP districts) would remain conditional uses. James said staff will continue follow‑up meetings with DNR and expected to bring negotiated language to the commission, likely in January.
Commissioners asked clarifying questions and took no final action on ordinance language at this meeting.
